Please note Terms and Conditions for Designs will be sent out out on an individualised basis.
By accessing this website and booking with us, we assume you accept these terms and conditions. Do not continue to use Cirkall.com if you do not agree to take all of the terms and conditions stated on this page.
The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements:
"Client", "You" and "Your" refers to you, the person log on this website and compliant to the Company’s terms and conditions.
"The Company", "Ourselves", "We", "Our" and "Us", refers to our Company.
"Party", "Parties", or "Us", refers to both the Client and ourselves.
All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing law of Australia. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.
Licesnse
Unless otherwise stated, Cirkall and/or its licensors own the intellectual property rights for all material on Cirkall.com. Cirkall owns both the copyright and the photos/videos/design. Cirkall's portfolio, marketing, and instructional aims will all be served by the photos/videos/design. All intellectual property rights are reserved. You may access this from Cirkall.com for your own personal use subjected to restrictions set in these terms and conditions.
You must not:
Republish material from Cirkall.com
Sell, rent or sub-license material from Cirkall.com
Reproduce, duplicate or copy material from Cirkall.com
Redistribute content from Cirkall.com
Booking
A reservation payment of $100 (or 50% of the quoted total) is required to confirm the booking; the balance is due when billed (deposit amount is flexible).
Clients agree to supply Cirkall with their email address and phone number for contact and sharing purposes.
Clients agree to submit details about the event, including the time, date, venue, number of attendees, theme, and lighting.
A base cost of $90 per hour ($25 for 15 minutes) is charged for on-the-spot hiring. This covers the price of editing and distributing.
There is a $55 surcharge for same-day bookings.
There is a $25 late booking fee if you request a reservation with less than 10 days notice (event date not included).
Pricing
Pricing and package deals are not permanent and may be changed at any moment;
Pricing and package deals may be adjustable based on the client's demands.
Payment
Following the event, an invoice will be provided. Please provide a screenshot of the digital transaction receipt to Cirkall through email at hello@cirkall.com.
There will be no content supplied until all funds have been received in full.
Time
If the customer wishes to add more photo/video hours to their booking, they will be charged the established hourly cost plus $25 per hour.
The agreed price on the estimate will be charged if the customer agrees to abbreviate the photo/video hours.
Photo/Video Submission
2 days will be required to deliver Physical Media/Album to the client's specified address.
After submission, edited photos/video will be archived for two months.
Cirkall cannot guarantee that the customer will receive the uploaded photos/video if they are lost after receiving them.
Original photographs can be requested within one week of the photo submission date by clients who have not purchased the add-on as part of their package. The payment will be $.50 per image plus the Original Image add-on.
Photo/Video Viewing
Cirkall.com photos/videos must be downloaded within ten days (please contact us if you require more time).
Using the URL and password, you may share any photos/videos uploaded on Cirkall.com with your friends and family.
Photos/videos will be removed from Cirkall.com 15 days after the final material has been submitted (please contact us if you require more time).
The photographs may be used as portfolio or marketing material on Cirkall's platforms.
Editing/Retouching
Cirkall must be informed in advance of the shoot if the client has any special editing techniques in mind. If Cirkall is not alerted, your photos/videos will be edited in an acceptable manner.
Exposure, contrast, sharpness, clarity, colour, and other factors will be altered in all photos/videos. Cirkall's will edit to the best of their knowledge and skill.
Due to uncontrolled lighting situations that may arise during the shoot, such as excessive brightness or darkness, some photos/videos may be of poor quality, however Cirkall will try their best.
Watermarking
The client must select photos that require no watermark and tell Cirkall within one week of receiving the photos.
With the exception of the add-on and package features, all photos/videos will be watermarked with Cirkall's logo.
Social Media
When you book with Cirkall, you acknowledge that the images and videos recorded during the event/shoot may be shared on Cirkall's social media and website at any point in the future, unless specified by the client. Please check our Privacy Policy for more details.
Complaints
Any problems with the picture/video/design submission must be communicated to Cirkall as soon as possible, no later than 10 working days after the photo was submitted.
Cirkall will do everything possible to remedy the problem.
Cirkall has the right to decline a client's request if the rationale is reasonable.
Cancellation
The deposit is non-refundable if the client chooses to cancel the booking. The amount of time between the cancellation and the scheduled date varies.
Cirkall will levy a cancellation fee of up to $100, with the remainder of the deposit reimbursed.
A mutual agreement can be established to reschedule a booking if it is postponed due to inclement weather/COVID19 or any unforeseen circumstances with sole discretion by Cirkall.
If Cirkall is unable to complete your booking or design work, all money will be reimbursed.
Sub-Contracting
Cirkall maintains the right, in its sole discretion, to subcontract any Services that Cirkall has committed to execute for the client.
Changes
We may update this Terms and Conditions from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.
